LAERSKOOL BRITS AND CF MOTO BRITS BIKE COMPETITION – TERMS AND CONDITIONS –

  1. INTRODUCTION

These terms and conditions apply to LAERSKOOL BRITS AND CF MOTOR BRITS BIKE COMPETITION (“the Giveaway”) more fully described below.

  1. KEY WORDS AND DEFINITIONS

The following words shall have the meaning given below. “Accountant” the accountants, appointed to oversee the Giveaway by the Laerskool Brits and CF MOTO BRITS BIKE Competition being: GKL AUDITORS; “Announcement Date” the 1st of August 2026; “Closing Date” means the 30th of July 2026 @ 24:00; “Draw Date” 1 August 2026; the draw date for the Raffle will be on 1 August 2026. However, if (for any reason) not all Raffle tickets are sold by the “Closing Date”, the draw for the Raffle may be postponed to a later date to be advised by CF MOTO and Laerskool Brits on the website where these terms and conditions will be posted. A maximum of 4000 tickets is available. “Draw 1” means the lucky (randomized) draw from the list of Participants to determine the single Participant that will be eligible for the Prize as further described below; “Participants” all the purchasers of raffle tickets as on the Closing Date (30th of July) of the Laerskool Brits and CF MOTO competition; “Laerskool Brits” Laerskool Brits is a public school and juristic person in terms of Section 15 of the South African Schools Act 84 of 1996 and the co-promotor of the Giveaway; “CF MOTO” is a private company situated at 3 Van Deventer Street, Brits, North-West, 0250, with registration number 2021/505224/07 and the co-promotor of the Giveaway; “Start Date” the date whereupon the Giveaway was announced being the 29 April 2026; “Rules” these terms and conditions; “The Giveaway” the random draw to be held in accordance with the Rules in terms whereof a Participant will win the Prize; “The Prizes” means the CF Moto 450MT bike and a Snomaster Fridge. If the winner is present at the Wildsfees during the announcement, he/she will also win a Snomaster Fridge to the value of R6999. If the winner is NOT present at the Wildsfees when the announcement is made,  he/she forfeits the Snomaster Fridge. A new draw, will then take place, immediately after, to determine a winner for the fridge. “The Winner” the Participant who wins the Giveaway as determined by the Draw.

  1. The Giveaway relates to the Prizes (CF Moto bike and Snomaster Fridge) as described above.
  2. The Prizes are supplied by CF Moto, situated at 3 Van Deventer Street, Brits, North-West, 0250.
  3. Requirements for participation in the Giveaway.
    • Only purchasers of the raffle tickets as sold are entitled to be included in the Draw;
    • Only purchasers of the raffle tickets will be eligible for the Prizes as at the Closing date and will be included in the draw;
    • Only natural persons (people) can qualify as purchasers;
    • Tickets may be purchased at www.lsbritsraffle.co.za
  4. How Giveaway winner will be determined.
    • As at the Closing Date the Accountant will determine the list of numbers of all the purchasers who qualify to form part of the Draw;
    • The Prizes in the Giveaway will not be awarded to any person from Laerskool Brits and CF Moto Brits who is directly involved with the presentation and the administration of the Giveaway.
    • Each purchaser from the list of purchasers, as aforesaid, will be assigned a single unique, sequential, number by the following Domain lsbritsraffle.co.za;
    • One number (correlating to the winning Participant) will be determined by means of a random number generator (RNG) being a computer program designed to, on random, pick a number, from the numbers assigned to the Participants, as above;
    • The RNG program used will be in the discretion of the Accountant;
    • The Participant so selected, shall win the CF Moto 450 MT, and if present at the Wildsfees, the Fridge as well;
    • The Draw and the Announcement will take place at on the 1 August 2026 at the Wildsfees in Brits by Appel (Artist) during his performance.
    • If it transpires that the winner or winners (in case the bike winner is not present) is disqualified from receiving the prize, a new Winner shall be determined.
    • Should a member accept the prize and it only becomes apparent afterwards that the member was disqualified, the member shall return the Prize.
    • A winner shall be disqualified, if the winner violated these rules or if it transpires that the winner has in some manner gained an unfair advantage in the Draw.
  5. Announcement of result
    • The Winner of the CF Moto 450MT will be contacted telephonically and by email on the Draw Date if the winner is not present at the Wildsfees where the announcement will take place and be informed of the result. With consent of the Winner a video will be taken and posted at the time of actual handover of the Prize.
    • If the winner of the CF Moto 450 MT is not present at the Wildsfees, a new draw will immediately take place in order to determine a winner for the Snomaster fridge. The winner needs to be present at the draw and the fridge will be handed over on stage. The winner of the fridge has to be present at the Wildsfees during this draw and announcement in order to win the fridge. The draw will continue until a participant who is present is drawn.
    • The Snomaster Fridge will be handed over to the winner at the Wildsfees at the announcement time. With consent of the Winner of the fridge a video will be taken and posted at the time of actual handover of the Prize.
    • The name and town of the winner/s will with consent of the Winner/s be announced, on the Announcement Date.

  1. Receipt of the Prize: CF Moto 450MT
    • The Winner of the Prize, CF Moto 450MT shall be entitled to collect the Prize from CF Moto Brits at the following address 3 Van Deventer, Brits, on prior notice and from Monday to Friday between 09h00 until 16h00 and excluding public holidays.
    • CF Moto Brits will provide the required documents to register the Prize into the name of the Winner at the Department of Roads and Transport, Madibeng and pay for the costs of registration thereof in the name of the Winner (but not the costs of any fines in the name of the Winner);
    • The Winner will become eligible for the Prize, subject to the Rules, and upon completion of the Draw and determination of the Winner;
    • Risk of loss or damage to the Prize will vest in the Winner on collection of it by the Prize.
    • Brits Ford reserves the right to require the full proof of identification (identity number), work, email and residential address of the Winner, before release of the Prize;
    • The Winner shall be required to make arrangements for and collect the Prize within 30 (thirty) calendar days of the Draw Date.
    • If the Winner fails to accept and collect the Prize within 30 (thirty) calendar days of the Draw Date, or to make arrangements for same to the reasonable satisfaction of Laerskool Brits and CF Moto Brits the Prize shall be forfeited and a new Winner shall be determined by means of a new draw to be conducted on the same basis as the first draw read with the necessary changes in context.
    • The prize may not be exchanged for cash and are non-negotiable, non-transferable and non-refundable.
  2. Receipt of the Prize: Snomaster Fridge
    • The Winner of the Prize, Snomaster fridge shall take delivery of the prize at the Wildsfees upon announcement. The winner will be called to stage to receive the prize (Snomaster Fridge).
    • The Winner will become eligible for the Prize, subject to the Rules, and upon completion of the Draw and determination of the Winner;
    • Risk of loss or damage to the Prize will vest in the Winner on collection of it by the Prize.
    • The draw will take place until a winner is drawn that is present at the Wildsfees.
    • The prize may not be exchanged for cash and are non-negotiable, non-transferable and non-refundable.
  3. No warrantees are provided
    • Other than for the warrantees provided by the manufacturer of the Prize (See: ‘the prize’ for warrantee and service agreement), no other warrantees are provided by CF Moto Brits in respect to the Prize.
    • CF Moto Brits will provide the Prizes and the Winner/s will accept all risk of damage, loss maintenance and repair in respect of the Prize from the delivery date.
  4. Indemnity

The Winner/s, by accepting the Prize/s, indemnifies (releases from and agrees to protect against) and undertakes to keep indemnified, CF Moto Brits and Laerskool Brits (as well as its directors, advisors, employees and representatives) in respect of the Prize/s, its use and operation. CF Moto Brits and Laerskool Brits (as well as its directors, advisors, employees and representatives) will not be liable for any accident, injury, damage, harm loss or loss of life that the Winner/s or any person who uses the Prize/s may suffer or that any person may suffer resulting from the use of the Prize/s.

  1. General conditions
    • CF Moto Brits and Laerskool Brits shall not be liable for any disruption to the Giveaway, whether due to technical problems or otherwise, which is beyond its reasonable control. If there is any disruption to the Giveaway CF Moto Brits and Laerskool Brits shall use its reasonable endeavours to remedy any disruption and resume the Giveaway in a fair manner and in due course.
    • CF Moto Brits and Laerskool Brits will not be responsible for any failure or inability of a Participant (purchaser of a raffle ticket) to: due to interruption, error, delay in operation or transmission, communications failure, website failure, or inability to process a raffle ticket purchase.
    • The laws of the Republic of South Africa will apply to the Giveaway.
